Welcome to TikaCam. These Terms of Service ("ToS") govern your access to and use of our video call service TikaCam. By using the Service, you agree to be bound by these ToS. If you do not agree, you may not use the Service.
1.1. Service Description: The Service allows users to connect and communicate directly via peer-to-peer video and audio calls. The platform facilitates these connections but does not store, access, or monitor the content shared between users.
1.2. Eligibility: You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet this age requirement.
1.3. No Registration Required: The Service does not require user registration. However, by using the Service, you accept full responsibility for your use of the platform and agree to comply with these ToS.
By using the Service, you agree that you will NOT:
3.1. Encryption: The platform uses peer-to-peer (P2P) technology via WebRTC, which encrypts communication end-to-end (E2EE). We do not access or store the content of communications.
3.2. No Access to Content: All video, audio, and data communications made through the Service are transmitted directly between users using end-to-end encryption. Our servers do not have access to the content of these communications. We cannot and do not monitor, view, or record the content shared during calls.
3.3. Content Moderation and Reporting: While we do not monitor the content of calls, users are encouraged to report any misuse or illegal activities. If notified of illegal content, we will investigate and take appropriate action, including suspension or termination of access.
3.4. User Responsibility for Content: You are solely responsible for the content you share or transmit via the Service. You agree not to share or transmit any illegal, inappropriate, or harmful content. Any violation of this may result in immediate termination of your access to the Service.
4.1. Minimal Data Collection: The Service only collects minimal metadata required for facilitating the peer-to-peer connection (e.g., IP address and pictures for establishing a connection). This data is not retained beyond the duration of your session and is never shared with third parties unless required by law.
4.2. Compliance with GDPR: We comply with the General Data Protection Regulation (GDPR). As a user, you have the right to request access to, correct, or delete any personal data we might collect (e.g., IP addresses). Given the nature of the Service, the amount of personal data collected is minimal.
5.1. No Monitoring: Since the Service provides peer-to-peer connections using encrypted communication, we do not monitor, control, or have access to the content transmitted between users. We are not responsible for any illegal or harmful content shared through the Service.
5.2. No Warranties: The Service is provided "as is" without any warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. We do not guarantee that the Service will be error-free, uninterrupted, or secure.
5.3. Limitation of Liability: To the fullest extent permitted by law, we disclaim all liability for any loss or damage arising from your use of the Service, including but not limited to:
5.4. User Indemnification: You agree to indemnify and hold TikaCam harmless from any claims, losses, damages, or liabilities, including legal fees, arising out of your violation of these ToS, illegal activities, or misuse of the Service.
6.1. Ownership of Content and Platform: All materials, including but not limited to the website design, concept, layout, underlying algorithms, source code, functionality, features, logos, graphics, text, software, and other content available on or through TikaCam Platform Content, are the exclusive property of TikaCam. These elements are protected by copyright, trademark, trade secret, and other intellectual property laws. You may not copy, reproduce, distribute, modify, display, perform, or create derivative works from any part of the Platform Content without prior written consent.
6.2. Protection of Algorithms and Code: The algorithms, methodologies, and code that power the TikaCam platform are proprietary to TikaCam. Any attempt to reverse engineer, decompile, disassemble, or otherwise tamper with the underlying technology or code is strictly prohibited and may result in legal action.
6.3. License for Limited Use: We grant you a limited, non-exclusive, non-transferable license to access and use the Service and the Platform Content solely for personal, non-commercial purposes. Any unauthorized use of the Platform Content or technology is strictly prohibited and may lead to termination of access or legal action.
6.4. User-Generated Content: If you submit or share content through the Service (e.g., messages or media), you grant TikaCam a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, display, modify, and distribute such content for the purposes of operating and improving the Service. However, this license is limited to the extent necessary for the provision of the Service, and TikaCam will not claim ownership of your content.
6.5. Copyright Infringement Notification: We respect the intellectual property rights of others. If you believe that any content available on our platform infringes your copyright, please provide us with a written notification that includes:
6.6. Termination for Copyright Violations: We reserve the right to terminate or suspend the accounts of users who repeatedly infringe upon the intellectual property rights of others.
We reserve the right to suspend or terminate your access to the Service at our discretion if you violate these ToS, engage in illegal activities, or disrupt the functioning of the platform.
We may update these ToS from time to time. You will be notified of any significant changes via the Service. Your continued use of the Service after such changes indicates your acceptance of the new terms.
